New York and New Jersey use different terms and follow different rules when it comes to sealing criminal records.
- New Jersey: One of the greatest things about the New Jersey criminal justice system is that certain individuals may have a record of their arrest and/or conviction wiped completely off of their record. - New York: Unlike New Jersey law, New York law does not allow for expungement. It does, however, allow sealing of criminal records when an outcome of a criminal case is favorable to the defendant. Many cases become favorable for sealing three years after the crime occurred, but it is best to talk with an attorney about your particular situation.
Are You Eligible for Expungement?
If you have a conviction for a local town ordinance, it may be expunged after two years. If a disorderly persons or petty disorderly persons offense is on your record, it may be expunged after five years.

A recent amendment to New Jersey's expungement law expands the eligibility for people to wipe clean their criminal record.
