Can you be charged with DWI below the legal limit?

A night out with friends or a casual dinner with family can quickly turn stressful when flashing lights appear in your rearview mirror. Many people believe that as long as their blood alcohol concentration (BAC) is below 0.08%, they’re automatically safe from a DWI charge. Unfortunately, that’s not always the case.

The truth is, the law focuses on your ability to drive safely, not just the number on a breathalyzer. Even if your BAC is below the legal limit, you could still face serious charges if an officer believes you were impaired behind the wheel.

Impairment Matters More Than the Number

While 0.08% is the legal threshold for intoxication in most states, it isn’t an absolute shield. Law enforcement officers can arrest drivers whose BAC is lower than the legal limit if there’s evidence of impairment. This can include erratic driving, slurred speech or failing field sobriety tests. Prescription medications, over-the-counter drugs and certain medical conditions can also contribute to impaired behavior, regardless of alcohol consumption.

Police observations, dash cam footage and witness statements can all play a role in a DWI case. For instance, a driver with a BAC of 0.05% who weaves between lanes or runs a red light could still be considered too impaired to operate a vehicle safely. The officer’s report and the evidence of impairment often carry significant weight, sometimes even more than the breath test itself.

Many drivers are surprised to learn that challenging a DWI charge involves more than disputing the BAC reading. Factors like improper testing, medical conditions or procedural errors can affect the outcome. However, even a low result doesn’t guarantee dismissal if other signs of impairment are present. Each case depends on the circumstances.

Facing a DWI charge, especially when you were under the legal limit, can be confusing and intimidating. It’s important to speak with an experienced legal professional who can review the details and guide you through the next steps toward the best possible outcome.
