About Our Work In The New Jersey And New York Juvenile Justice Systems

Every child needs his or her own personalized defense. All children are unique with different needs and different circumstances related to their case. In New Jersey and New York, the juvenile justice systems do not simply focus on punishment. They are about rehabilitation. This may include participation in drug treatment or anger management programs, or psychological and peer interaction counseling. What Courts Handle Juvenile Cases?

When a juvenile is charged with a crime or offense, those charges do NOT go to a regular criminal court. Instead, the case is heard by a New Jersey Superior Court judge, assigned to the Family Division.

The document which brings the juvenile to court is called a juvenile delinquency complaint. The focus of the proceeding is to determine whether certain consequences or rehabilitation services may be appropriate to assist a child who is charged criminally.

In a regular criminal case where an adult is charged with a crime or offense, the case is captioned, “The State of New Jersey v.” and then the defendant’s name. In juvenile matters, where the focus is more towards rehabilitation, the case is captioned, “In the Interest of” and then the juvenile’s name. This is a significant difference.
