In New Jersey, the law allows a person to have certain arrests removed from their criminal record. The expungement of arrest records can be especially valuable for individuals whose jobs or educational pursuits require them to have a clean record. Changes In Record Expungement Laws Could Benefit You
In 2020 and 2021, new laws went into effect in New Jersey shortening the wait time for applying for record clearance and allowing more people to expunge more charges. People convicted of certain crimes are now eligible to apply for expungement five years after the date of conviction, termination of probation or release from prison – whichever is later. If the expungement is for compelling reasons, that time is reduced to four years.
Individuals may be eligible to have their entire criminal record expunged – crimes and disorderly persons convictions combined – 10 years after the date of conviction, termination of probation or release from prison, whichever is later.
A conviction for a disorderly persons offense or petty disorderly persons offense may be expunged after five years, and if an expungement is for compelling reasons, the wait time may be reduced to three years.
The law allows for the expungement of an indictable conviction even if an individual has as many as three disorderly persons offenses. It also allows for the expungement of up to five disorderly persons offenses.
