Will I have to Register as a Sex Offender?

In some cases, the law requires that a sex offender be placed on a registry or database of convicted sexual offenders. This is commonly referred to as Megan’s Law.

It is the registrant’s responsibility to regularly notify law enforcement about where they are living, working and going to school. It also means that the community will be notified about this information. In some cases, the registrants photograph will be on-line.

There are different levels of registration and community notification and the level is determined in a confidential closed-door hearing, called a Megan’s Law tier hearing.

All sex offenses do not require registration. Whether or not you will have to register depends on the outcome of your case.

The most serious sexual assaults all require registration. For example, aggravated sexual assault, sexual assault, aggravated criminal sexual contact, endangering the welfare of a child by possessing over 1000 images of child pornography, criminal sexual contact if the victim is a minor are some of the charges that require registration.

Sexual offenses that do not require registration include criminal sexual contact if the victim is not a minor, lewdness, invasion of privacy, prostitution, possession of less than 1000 images of child pornography.
