Sometimes intoxication is a factor in sexual assault allegations. While there are certainly people who do take advantage of others who are intoxicated, some situations involve hazy recollections and false statements that lead to criminal charges. The fact of the matter is that prosecutors must have hard evidence linking a person to the commission of a sex crime.

With those issues in mind, our readers in Hackensack may be interested in the recent sentencing of a Bayonne man. He was sentenced to 60 years in prison after being convicted of kidnapping and sexually assaulting a New York woman. Though the incident in question occurred in 2005, it wasn't until this year that the state was able to obtain a criminal conviction because the case had gone cold shortly after the victim reported the crime.

According to records, the woman was attending a bachelorette party in Hoboken when the defendant and a West New York man allegedly abducted her from a street corner. She claimed that she was sexually assaulted in a vehicle before being stranded naked in Palisades Park.

The woman was unable to identify any suspects because she had been intoxicated at the time. However, the Bayonne man was arrested in 2007 when the woman's driver's license was found in the West New York man's vehicle while the police were investigating an unrelated case. That discovery led police to the Bayonne man. A sample of his DNA was taken, and authorities said it matched up with semen found on the woman shortly after she reported to police.

Sexual assault cases can become especially complicated if the accuser was intoxicated at the time of the alleged crime.
